Terms of Service and Privacy Policy

1. Introduction and Overview
Welcome to the BrainScreen app (the “App”), developed and owned by Safe Living Space, a California nonprofit public benefit corporation (“we,” “us,” or “our”). The App is designed solely for educational and informational purposes to raise public awareness about signs and symptoms commonly associated with traumatic brain injury (TBI). It is not a medical device and does not provide diagnostic, therapeutic, or medical advice.
By downloading or using the App, you agree to be bound by these Terms of Service and Privacy Policy (collectively, the “Terms”). If you do not agree, do not use the App.
Use of the App is also subject to the terms of service and policies of the app store from which you downloaded it, such as the Apple App Store or Google Play Store.
2. Important Disclaimer: No Medical Advice
The App is not a medical device. It does not diagnose, treat, mitigate, cure, or prevent any disease or condition. It has not been reviewed or approved by the FDA. You acknowledge that any use is at your own risk and that no content within the App should be construed as professional or medical advice. Always consult with a licensed professional regarding any health concerns.
3. User Conduct and Acceptable Use
You agree not to use the App for any unlawful, harmful, or deceptive purposes, or to interfere with its operation. Prohibited conduct includes introducing malware, collecting unauthorized data, impersonating others, or using automated systems (bots, scripts, etc.) to interact with the App beyond normal human use. Violations of these rules may result in immediate suspension or termination of your access to the App and may expose you to legal liability.
4. Privacy Policy
We are committed to protecting your privacy. The App collects limited data to help us operate effectively, improve the user experience, and contribute to public health understanding in a deidentified manner. This Privacy Policy also serves as our “Notice at Collection” under the California Consumer Privacy Act and the California Privacy Rights Act.
Information We Collect:
Information You Provide Voluntarily. When using the App, you may choose to provide information such as:
· Self-reported responses to prompts, questions, or assessments;
· User preferences, including reminders, settings, or content delivery; or
· Feedback or survey responses.
Device and Technical Information. We may automatically collect certain technical and usage-related data, including:
· Device type, operating system, and screen resolution;
· Language and region settings;
· Timestamps of use and feature engagement (e.g., which modules are accessed); or
· Crash logs and performance diagnostics.
Usage Analytics and Behavioral Data. We may use analytics tools (such as Firebase or similar services) to collect usage and behavioral data such as:
· Time spent in the App;
· Navigation patterns and screen flows; or
· Completion of assessments or interaction with reminders.
How We Share Information
We do not sell, rent, or share personally identifiable information with third parties. We may share aggregated, deidentified, or anonymized data that cannot reasonably be linked to any individual with:
· Public health researchers;
· Academic institutions;
· Policy and advocacy organizations; and
· Other nonprofit and healthcare stakeholders.
How We Use Your Information:
The information we collect is used or shared for the following purposes:
· To operate, maintain, and improve the App’s content and functionality;
· To conduct anonymized statistical and usage analysis;
· To understand and enhance user engagement;
· To identify areas where users may benefit from expanded content or features; or
· To support education, research and public awareness about traumatic brain injury.
We do not use your data to make automated decisions about you or for any advertising or marketing purposes.
5. Business Transfers
If Safe Living Space is involved in a merger, acquisition, or sale of assets, your data may be transferred as part of that transaction. We will ensure the successor honors this Privacy Policy or notify users of significant changes.
6. Compliance with Law
If legally requested, we may cooperate with government and law enforcement officials or private parties, to enforce and comply with the law. We may disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims or legal process (including subpoenas), to protect our property and rights or those of a third party, the safety of the public or any person, to prevent or stop any illegal, unethical, or legally actionable activity, or to comply with the law.
7. Cookies and Third-Party Services
The App may use or integrate with third-party tools (e.g., Google Play, Google Firebase, Apple iCloud, and Apple Analytics) that use cookies or collect anonymized usage data. These are governed by their respective privacy policies. You can disable cookies via device settings, though this may limit functionality.
8. Feedback and User Submissions
Any suggestions or feedback provided may be used to improve the App without compensation. Do not submit sensitive personal or medical information.
9. Children’s Privacy
The App is not intended for individuals under 18. We do not knowingly collect personal data from children. If we discover data submitted by a minor, it will be deleted promptly.
10. Your Rights (California Residents)
Under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), residents of California have specific rights regarding their personal information. If you are a California resident, you have the right to:
· Know the categories of personal information we collect, the purposes for which we use it, and the categories of third parties with whom we may share it;
· Access specific pieces of personal information we have collected about you (once per 12-month period);
· Request deletion of personal information we have collected, subject to certain exceptions permitted by law (e.g., to comply with legal obligations or ensure App functionality);
· Request correction of inaccurate personal information;
· Limit the use and disclosure of sensitive personal information (if collected; we do not currently collect or use such information in a way that triggers this right);
· Opt-out of the sale or sharing of personal information (we do not sell or share your personal information for cross-context behavioral advertising); and
· Not be discriminated against for exercising any of your privacy rights.

We may need to verify your identity before fulfilling your request. We will respond within 45 days, as required by California law, and will notify you if additional time is needed.
11. Data Retention and Security
We retain deidentified data for analytics indefinitely. We use commercially reasonable safeguards, but cannot guarantee complete data security.
12. Limitation of Liability
THE APP IS PROVIDED “AS IS” WITHOUT WARRANTIES, EXPRESS OR IMPLIED, including but not limited to implied warranties of merchantability or fitness for a particular purpose, accuracy, reliability, or availability of the App, that the App will be uninterrupted, secure, or error-free, or that any issues will be corrected. You agree that we will not be liable for any indirect, incidental, consequential or punitive damages, and that our maximum liability, under any theory including negligence, is limited to $100 or the amount paid in the previous 12 months, whichever is less. Some jurisdictions do not allow certain exclusions or limitations; in such cases, our liability is limited to the maximum extent permitted by law.
13. Changes to Terms or Privacy Policy
We may update these Terms at any time. Material changes will be posted in-app or via notification. Your continued use constitutes acceptance of any updates.
14. Governing Law
These Terms are governed by California law, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in the Northern District of California.
